Terms of Service

Welcome to GoldPriceZ.com (“GoldPriceZ,” “we,” “our,” or “us”). These Terms of Service (“Terms”) are a legally binding agreement between you and GoldPriceZ governing your use of our websites, tools, charts, calculators, APIs, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

1) Acceptance & Eligibility

You may use the Services only if you can form a binding contract with us and are not barred from using the Services under applicable law. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization and “you” includes that organization.

2) What We Do

GoldPriceZ is an independent market-information platform. We publish transparent prices, charts, comparisons, and tools so users can track values and understand how they are derived.

• Precious metals: Live/recent pricing for gold and silver across units (troy ounce, gram, kilogram, tola, tael, baht, masha, ratti, and others) and purities/karats (24K, 22K, 18K, 14K, 10K, etc.), in 150+ currencies.
• Other assets: Selected cryptocurrencies (e.g., Bitcoin) and crude oil prices; where available, platinum and palladium. We plan to expand into stocks and additional commodities.
• Tools: Calculators (gold/silver value, scrap gold, jewellery), currency converter, historical tables, charts, performance views, comparisons, and country-specific pages.
• API: A free API that exposes selected pricing data for non-SLA, informational use (see API Terms).

3) Market Data, Timing & Accuracy

We license core market and FX data from reputable provider(s). Our systems can retrieve rates up to twice per minute; provider feeds typically update once per minute. Minor timing differences can occur due to provider schedules, network latency, and caching.

Most pricing pages include a Reference / Methodology section that outlines the calculation flow (e.g., spot in USD → FX conversion → unit & karat adjustments), the data provider’s last update time, and links to relevant sources. Displayed values may differ from quotes offered by banks, card networks, exchanges, retailers, or jewelers due to spreads, fees, taxes, and local market conditions.

4) License to Use the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal or internal business purposes. Except as expressly permitted, you may not copy, modify, create derivative works, distribute, sell, lease, sublicense, frame, or scrape the Services or content.

5) Acceptable Use & Restrictions

• No unlawful, infringing, deceptive, or harmful activity.
• No automated harvesting/scraping outside normal web indexing compliant with our robots.txt and rate limits.
• No attempt to bypass technical protections (rate limits, authentication, geoblocks) or to overload, DDoS, or interfere with operation.
• No reverse engineering or access to source code.
• No resale, republication, or commercial exploitation of site content or API outputs without our written permission or a separate license.

6) API Terms (Free Tier)

Access to our API is provided on a free, no-SLA, “as-is” basis. We may require registration (e.g., email, site name/URL) and issue API keys, which you must keep confidential.

• Rate limits: You must comply with posted or key-specific limits. We may throttle, suspend, or revoke access for overuse or suspected abuse.
• Caching & freshness: You may cache responses for performance but must respect any cache headers and avoid representing cached data as “real-time.”
• Attribution: When publicly displaying API-derived values, include reasonable attribution (e.g., “Source: GoldPriceZ.com”).
• No sublicensing: Do not re-package or resell the API or datasets.
• Changes: Endpoints, schemas, limits, or availability may change or be discontinued at any time.

7) AI / Experimental Features

We may offer AI-assisted or beta features (e.g., natural-language summaries, alerts, or exploratory tools). These are experimental, may generate incomplete or inaccurate content, and are not a substitute for professional advice. You must independently verify outputs before relying on them. We may enable/disable or change these features at any time.

8) Feedback & User Content

If you send ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation. You represent that your submissions do not infringe others’ rights.

9) Intellectual Property

The Services and all content, trademarks, logos, and data compilations are owned by us or our licensors and protected by IP laws. No rights are granted except as expressly stated in these Terms.

10) Third-Party Links, Ads & Affiliates

The Services may reference or link to third-party sites, data, ads (e.g., Google AdSense), or affiliate offers. We do not control or endorse third-party content and are not responsible for their products, services, practices, or policies. See also our Affiliate Disclosure.

11) No Investment, Trading, or Legal Advice

All content is provided for general informational purposes only. GoldPriceZ is not a broker, dealer, exchange, advisor, or law firm; we do not buy/sell assets, and we do not provide investment, trading, tax, accounting, or legal advice. Do not use our content in legal proceedings or as a sole basis for transactions. Always consult qualified professionals.

12) Privacy & Cookies

Your use of the Services is subject to our Privacy Policy and Cookie Policy, which explain how we collect and use information and how third parties may place or read cookies.

13) Security; Vulnerability Disclosure

Access our site only over https://goldpricez.com (look for the HTTPS padlock). We do not distribute executables, mobile apps, or downloads unless explicitly announced. If you discover a security issue, responsibly disclose it via goldpricekg@gmail.com. Do not exploit, exfiltrate, or disrupt systems.

14) Availability; Changes; Force Majeure

We do not guarantee uninterrupted or error-free operation. Features, datasets, and interfaces may change or be discontinued, with or without notice. We are not liable for delays or failures due to events beyond our reasonable control (force majeure).

15) DMCA / Copyright

If you believe content on the Services infringes your copyright, send a DMCA notice including: (a) your contact details; (b) identification of the work claimed infringed; (c) the specific URL(s) of the allegedly infringing material; (d) a good-faith statement; (e) a statement under penalty of perjury of accuracy and authority; and (f) your physical or electronic signature. 16) Global Use; Export Controls & Sanctions

You must comply with all applicable laws. You may not use the Services if you are located in a jurisdiction subject to comprehensive sanctions or are on any government sanctions list. We may restrict access where required.

17) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY, AND ACCURACY. DATA MAY BE DELAYED, INTERRUPTED, OR CONTAIN ERRORS.

Some jurisdictions do not allow certain disclaimers; in such places, the foregoing applies to the fullest extent permitted by law. Read more on Disclaimer.

18) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDPRICEZ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD SHALL NOT EXCEED THE GREATER OF (A) USD $50 OR (B) THE AMOUNTS YOU PAID US (IF ANY) FOR THE SERVICES IN THAT PERIOD. THESE LIMITATIONS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

19) Indemnification

You agree to defend, indemnify, and hold harmless GoldPriceZ from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Services, your violation of these Terms, or your infringement of any third-party rights.

20) Changes to These Terms

We may update these Terms by posting a revised version with a new “Last Updated” date below. Changes are effective upon posting. Your continued use after changes constitutes acceptance. We may, at our discretion, highlight material changes with a site notice, but are not obligated to do so.

21) Dispute Resolution That Minimizes Cost

Informal Resolution (30 Days). Before filing any claim, you agree to email us at goldpricekg@gmail.com with a brief written notice describing the dispute, your contact details, and the relief you seek. We will work in good faith to resolve the issue within thirty (30) days.

Small-Claims Preference. If your claim qualifies, either party may bring an individual action in a small-claims court of your place of habitual residence or the place where GoldPriceZ.com is established. We encourage this route because it is low cost and fast.

Remote, Documents-Only Arbitration (Non-Consumer or Larger Claims). Except where prohibited by law, and except for claims that may be brought in small-claims court, any dispute arising out of or relating to these Terms or the Services will be finally resolved by binding arbitration conducted remotely on a documents-only basis (video/phone hearing only if the arbitrator finds it necessary). The arbitration will be conducted by a single neutral arbitrator under the UNCITRAL Arbitration Rules, as modified by this section. The arbitration language will be English.

• Seat & Governing Law for Arbitration. The arbitral tribunal will determine the seat and any non-mandatory governing law with regard to the parties’ locations and applicable mandatory law. Hearings, if any, will be held remotely.
• Costs. Each party bears its own attorneys’ fees, subject to any non-waivable consumer protections. Administrative and arbitrator fees will be split equally; however, for claims you file up to USD 1,000 (or local equivalent), we will reimburse your share of such fees after you provide reasonable proof of payment, unless the arbitrator finds the claim frivolous. Nothing limits any fee-shifting required by applicable law.
• Relief & Consolidation. To the maximum extent permitted by law, proceedings are on an individual basis only and not as a class, consolidated, or representative action. The arbitrator may award individual monetary or injunctive relief that is necessary to resolve your claim but may not award class-wide or public-injunctive relief where such limitations are enforceable.
• Opt-Out. You may opt out of this arbitration agreement and class-action waiver by emailing goldpricekg@gmail.com within thirty (30) days of first accepting these Terms, stating “Arbitration Opt-Out” and your account/email identifier. Opting out will not affect other terms.
• Court Carve-Out. Either party may seek temporary injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property, confidential information, or site security.

22) Governing Law, Venue & Consumer Rights

To the extent permitted by applicable law, these Terms and any non-consumer dispute are governed by the laws of the jurisdiction in which GoldPriceZ.com is established, excluding its conflict-of-laws rules. If you are a consumer and the laws of your habitual residence grant you mandatory protections (including the right to use your local courts), those protections remain and prevail.

23) Severability & Order of Precedence

If any provision of these Terms is found unenforceable, the remainder remains in effect, and a valid term reflecting the parties’ intent will be substituted to the extent permitted by law. If these Terms conflict with product-specific terms or policies, the product-specific terms control for that product.

24) Time Limits

To the extent permitted by law, any claim arising out of or relating to the Services must be filed within one (1) year after it accrues; otherwise, the claim is permanently barred.

25) Miscellaneous

• Entire agreement: These Terms, together with our Disclaimer, Privacy Policy, Cookie Policy, API Terms, and any posted methodology notes, constitute the entire agreement.
• Severability: If any provision is held invalid, the remaining provisions remain in full force.
• No waiver: Our failure to enforce any provision is not a waiver.
• Assignment: You may not assign these Terms without our consent. We may assign to an affiliate or in connection with a merger, acquisition, or asset sale.
• Translations: Translations are provided for convenience; the English version controls in case of conflict.
• Electronic communications: You consent to receive notices electronically.
